28 Excavation to Vacation Guarantee

28 Day Guarantee: Construction shall commence after permits have been obtained and financing arrangements and documents have been completed. Pool is to be completed within 28 business days from the completion of excavation (business days are defined as Monday through Friday, excluding holidays). ABC Pool & Spas shall proceed expeditiously to complete the pool, but shall not be responsible for delays caused by acts of God, Customer or Customer's agents, weather, strikes, lack of property access, government action or inaction, vandalism, and Customer's failure to make payments when due, or other reasons beyond ABC Pool & Spas' control.

The date of completion shall be extended 3 days for each and every day of delay caused by any and all of the events referred to herein and shall be extended 3 days for each and every day that the Buyer shall be late in making any installment payments as provided for herein.

Construction shall be deemed completed when the pool is plastered, not with-standing the fact that Customer has not connected water, electricty or fuel or that repairs or warranty work may not have been completed.
